I hereby enter into this agreement in consideration of permission to ride or be a spectator at Equine Corral Productions LLC Open Hunter event held on or about April 24, 2010 in conjunction with and at Galaxy Farms, Riverview, Florida.
IMPORTANT NOTICE
BY SIGNING THIS AGREEMENT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR RIDING OR USE OF THE OWNER’S HORSE AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT Equine Corral Productions LLC Open Hunter event held on April 24, 2010 at Galaxy Farms, INCLUDING INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE NEGLIGENCE OF YOU OR Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), Galaxy Farm LLC, Jana Grimm, Pamela Raker, their agents, assignees or other participants.
READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOUR UNDERSTANDING OF AND AGREEMENT TO ITS TERMS.
By signing this form, I hereby acknowledge on behalf of myself that I have familiarized myself with the activities that I will be allowed to participate in, and that I do hereby acknowledge and agree that I will participate in these activities without restriction or limitation. I recognize the inherent risks involved in riding and working with horses, including but not limited to:
- Bites, kicks, abrasions or contusions from horses.
- Being thrown or bucked off by horses.
- Scratches or other injury from stalls or enclosures.
- Scratches or other injury from grooming tools and other equine equipment and tack.
- Allergic reactions to animals, hay, or other allergens.
- Tripping in holes or on materials or equipment.
- Slipping, falling, or otherwise being injured in the barn, in stalls, or on the grounds, which can be slippery, muddy, wet, or contain or present other hazards.
I hereby specifically forever waive and release Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), Galaxy Farm LLC and its principals and agents from any liability for injury arising out of the inherent risks from riding, working or participating in a stable environment and/or with horses, as well as from the active negligence of Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), Galaxy Farm LLC, Jana Grimm, Pamela Raker, their agents, assignees or other participants.
By signing this agreement I hereby acknowledge that although there may be supervision during my time spent at Equine Corral Productions LLC Open Hunter event held on April 24, 2010 and will not guarantee there will be a nurse or other medical professional on the premises and Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), nor Galaxy Farm LLC and its principals and agents will bear no responsibility for my health or medical care.
By signing this agreement I hereby acknowledge the following both individually and as a whole that:
1. Acknowledge that horseback riding is a dangerous activity and involves risks that may cause serious injury and in some cases death because of the unpredictable nature and irrational behavior of horses, regardless of their training or past performance.
2. Knowing these facts and in consideration of your acceptance of this form, I voluntarily assume the risk and danger of injury or death inherent in horseback riding activities. I hereby release, discharge and promise not to sue the Companies doing business under their name or any other name and/or any of its owners, officers, employees, agents, sponsors or sanctioning organizations (hereinafter referred to as the Releasees) for any loss, liability, damage, or cost whatsoever arising out of or related to any loss, damage, or injury including death to my person or property
3. Agree to release the Releasees from any claim that Releasees are or may be negligent in connection with my riding experience or ability including but not limited to training or selecting horses, maintenance, care, fit or adjustment of saddles or bridles, instruction on riding skills or supervising riding activities.
4. Indemnify, and save and hold harmless the Companies and their employees and agents from and against any loss, liability, damage or cost they may incur arising out of or in any way connected with any event, my use of a horse and any equipment or gear provided therewith or any acts or omissions of employees or agents.
5. Agree to abide by and follow any instructions given or rules established by the Companies or any of its employees, agents or volunteers with regard to my participation in any event, use of a horse or any equipment or gear provided therewith.
6. The undersigned expressly agrees that the foregoing release and waiver of liability, assumption of risk, and indemnity agreement is governed by the state of Florida and is intended to be as broad and inclusive as permitted by Florida law, and that in the event any portion of this agreement is determined to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the balance of the Agreement shall not be affected or impaired in any way and shall continue in full force.
7. I hereby grant Equine Corral Productions LLC, Rolling Gait Equine LLC, Galaxy Farms LLC and their subsidiaries and agents permission to use my photograph or video in any and all publications including web site entries without payment or other consideration in perpetuity. I hereby authorize them to edit, alter, copy, exhibit, publish or distribute this photo or video. I waive the right to inspect or approve the finished product including written copy, wherein my photo appears. Additionally I waive the right to royalties or other compensation arising or related to the use of this photograph or video.
8. Acknowledge that this document is a contract and agree that if a lawsuit is filed against the Companies or its owners, agents, employees, judges, or managers for any injury or damage in breach of this contract, the undersigned will pay all attorney’s fees and cost incurred by the Companies in defending such action.
I agree to indemnify, save and hold harmless Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), Galaxy Farm LLC and its principals and agents from and against any loss, liability, damage, attorneys fees, or costs that they may incur arising out of or in any way connected with either my presence or participation at Equine Corral Productions LLC Open Hunter event held on April 24, 2010 or any acts or omissions of Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), Galaxy Farm LLC principals or agents.
By signing this Agreement, and by initialing the paragraph below, I hereby acknowledge my complete understanding, agreement and consent to my presence and/or participation in the activities at Equine Corral Productions LLC Open Hunter event held on April 24, 2010, without restriction, without liability to Equine Corral Productions LLC, Rolling Gait Equine LLC (dba Equine Corral), Galaxy Farm LLC, its principals or agents, and with full knowledge and understanding of the disclosures, waivers, and releases herein.
